Warranty Policies

For information about warranties, read the policy for your region.

As a consumer, you have certain statutory warranty rights under local law, in relation to your purchases. These are your legal consumer rights. They may allow you to request a repair (fix), a partial or full refund, or a replacement for a faulty EQUUSports Inc. game or other offering from the retailer (including digital content from EQUUSports Inc.) that you bought it from.

Australia

What are my statutory rights under the consumer guarantee provisions of the Australian Consumer Law?

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

These rights apply to both physical (or hard copy) games as well as digitally downloaded games.

European Union

Statutory rights

As a consumer, you have certain statutory rights under local law. For a period of two years (or longer for live services digital content), the physical disc, and the digital content, as may be updated from time to time, shall be without material defects. These are your legal rights and may allow you to request a repair, a partial refund, or a full refund or replacement for a faulty EQUUSports Inc. game or other offering from the retailer that you bought it from.

European Union - France

Statutory rights

As a consumer in France, you have certain statutory rights under local law. These are your legal rights and may allow you to request a repair, a partial refund, or a full refund or replacement for a faulty EQUUSports Inc. game or other offering from the retailer that you bought it from.

The consumer has a period of two years from the date of supply of the digital content or service in which to obtain implementation of the legal guarantee of conformity in the event of a lack of conformity. During a period of one year from the date of supply, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

The legal guarantee of conformity implies an obligation to provide all updates necessary to maintain the conformity of the digital content or service.

The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following his request, at no cost and without any major inconvenience to him.

The consumer may obtain a price reduction by keeping the digital content or the digital service or he may terminate the contract by obtaining a full refund in return for giving up the digital content or the digital service, if :

  1. The trader refuses to bring the digital content or digital service into conformity;
  2. There is an unjustified delay in bringing the digital content or service into compliance;
  3. The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
  4. Bringing the digital content or service into conformity causes major inconvenience to the consumer;
  5. The non-conformity of the digital content or digital service persists despite the trader's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a reduction in price or to rescission of the contract where the lack of conformity is so serious that it justifies immediate reduction in price or rescission of the contract. In such cases, the consumer is not obliged to request that the digital content or service be brought into conformity beforehand.

In cases where the lack of conformity is minor, the consumer only has the right to cancel the contract if the contract does not provide for the payment of a price.

Any period during which the digital content or service is unavailable for the purpose of bringing it back into conformity suspends the guarantee that remained in force until the digital content or service was once again in conformity.

The rights mentioned above result from the application of articles L. 224-25-1 to L. 224-25-31 of the Consumer Code.

Any professional who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).

Consumers also benefit from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or service is retained, or to a full refund in exchange for renouncing the digital content or service.

Japan

As a consumer in Japan, you may have certain statutory rights under local law with respect to defective goods and/or services. Please contact the retailer who originally sold you the EQUUSports Inc. game or other physical media.  

Korea

Statutory rights

As a consumer in the Republic of Korea, if digital content you have purchased is faulty or defective, you are entitled by law to claim a refund within one of the following time periods, whichever ends earlier: 

  • 3 months from the date of delivery of digital content 
  • 30 days after you become aware of the defect in the digital content. 

You will not be entitled to claim a refund if 

  1. you are responsible for causing the fault or defect in the product; or 
  2. any of the time periods specified above have expired.

Mexico

As a consumer in Mexico, you have certain statutory rights under local law. These are your legal rights and may allow you to request a repair, a partial refund, or a full refund or replacement for a faulty EQUUSports Inc. game or other offering from the retailer that you bought it from.

Taiwan

As a consumer in Taiwan, you may have certain statutory rights under local law with respect to defective goods and/or services.

United Kingdom

As a consumer in the United Kingdom, you have certain statutory rights under local law. United States and Canada

We warrant to the original purchaser of an EQUUSports Inc. product that the product is free from defects in both materials and workmanship for 90 days from the day you bought it.

If the product is found to be defective within those 90 days, please return it to the original retailer together with proof of purchase.

This warranty does not apply to discs that have been damaged by you through accident, misuse, or excessive use.

We are not responsible for any damages that are caused by possession, use, or malfunction of this product. That includes damage to property and, to the extent permitted by law, damages for personal injury, even if we have been advised of the possibility of those damages. Some jurisdictions do not allow limitations to how long an implied warranty lasts, so the limitations described above may not apply to you. In those jurisdictions, our liability is limited to the fullest extent permitted by law. This warranty gives you specific rights. You may also have rights that vary between jurisdictions.
